“Caledonia” means Caledonia Investments plc and any of its subsidiaries and related companies and references to the “Caledonia Site” is to the Caledonia’s site at www.caledonia.com (also accessible at www.caledonia.co.uk) including but not limited to the text, images, links, sounds, graphics and video sequences displayed in the Caledonia Site (the “Materials”).

Caledonia is registered in England and Wales under company registration number 00235481 with its registered office at Cayzer House, 30 Buckingham Gate, London SW1E 6NN.

Nothing in the Caledonia Site or the Materials is, nor is it intended to be, the communication of any invitation or inducement to any person to make any investment or divestment or to engage in investment activities nor an offer to acquire or dispose of securities or a solicitation in respect thereof.  Caledonia is not issuing, promulgating or providing any financial or other advice to any person and is not making and does not intend to make an offer or solicitation in relation to any securities of Caledonia or any other entity included in the Caledonia Site or the Materials.

The price of shares and the income derived from them can go down as well as up and investors may not get back the amount originally invested. Investors should be aware that past performance is not necessarily a guide to future performance.

Limitation of liability
To the fullest extent permitted by applicable law and regulation, Caledonia shall not be liable to any person who accesses the Caledonia Site or any of the Materials for any direct, indirect, special, consequential damages or awards of any kind, which may result from the use or inability to use the Caledonia Sites or any of the Materials.

Disclaimer
The Materials and the Caledonia Site are provided on an “as is” and “as available” basis and, to the fullest extent permitted by applicable law and regulation, Caledonia gives no warranties, express, implied or statutory as to merchantability or fitness for purpose of the Materials or that any of the Materials or the Caledonia Site will be provided uninterrupted or free from errors or that any identified defect will be corrected; further, no such warranty is given that the Caledonia Site and the Materials are free from any virus or other malicious, destructive or corrupting code, programme or macro. Caledonia does not warrant that the Caledonia Site or the server(s) that make(s) them available are free of any virus or other harmful elements. Reference in the Caledonia Site and/or the Materials to any hypertext link, product, process or service does not imply Caledonia’s support for, or endorsement or recommendation of, the provider thereof or the product, process or service to which reference is made. The Caledonia Site may contain links to other web sites, resources or other third parties. Caledonia is not responsible for the availability of these external web sites or their contents and Caledonia is not a sponsor, partner, promoter or publisher of such sites or their contents and accepts no liability in relation thereto.

Copyright and trade marks
The Materials are the copyright of Caledonia and may not be copied, distributed, uploaded, posted, republished, decompiled, disassembled, reverse-engineered or transmitted in any way without the prior, written consent of Caledonia. You can, however, download one copy for your personal non-commercial use or non-commercial use within the organisation in which you work on condition that you do not delete or change any copyright, trade mark or other proprietary notice contained in the Materials nor alter the way in which they are presented. Modification or use other than as permitted above violates Caledonia’s intellectual property rights in the Materials.

The trademarks, service marks and logo (the “Trademarks”) used and displayed on the Caledonia Site are registered and unregistered Trademarks of Caledonia and others. Nothing on the Caledonia Site should be construed as granting any licence or right to use any Trademark displayed on the Caledonia Site. Caledonia enforces infringements of its intellectual property rights to the extent permitted by the law.

Governing law
The agreement between Caledonia and you relating to your use and browsing of the Caledonia Site is governed by and shall be construed in accordance with English law. These terms and conditions constitute the entire agreement between us relating to your use and browsing of the Caledonia Sites and may not be modified unless Caledonia agrees in writing.
